Man arrested after pointing gun at federal agents, then stashing it next to diapers and baby bottle as he ran off with toddler

A man is facing federal charges after prosecutors say he pointed a gun at a federal agent and instructed him and others to “keep walking” while a small child stood by his side.

Joseph Hammond was arrested early Wednesday after agents from the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives responded to a call of an armed man holding a book bag and a baby and shooting in the 900 block of West 68th Street, according to a complaint filed Wednesday in U.S. District Court.

When the agents arrived, Hammond pointed a handgun with an extended magazine at one of the agent’s faces and instructed them to “keep moving,” according to the complaint. Hammond then picked up the child and ran.

About 12:45 a.m., Hammond was found walking on West 68th Street with a backpack, the toddler and another small backpack. Agents drove toward Hammond, announcing themselves and instructing him to stop and show his hands.

As the agents arrested Hammond, they saw an extended magazine and the pistol grip of a gun inside the open backpack. The firearm was a 10mm loaded Glock, according to the complaint. In images from the court filing, the gun is seen next to diapers and a baby bottle.

Hammond apologized to the agents and told them he did not realize they were law enforcement. All agents were wearing vests with the word “Police,” according to the complaint.

He was charged with unlawful use of a firearm by a felon.

Hammond has several previous convictions, according to federal prosecutors. They include a 2006 first-degree murder conviction for which he served 6 years, and a 2008 conviction for aggravated assault of a police officer for which he served 3 years.
